ASHES is a private server that allows you to replay a faithful and meticulous reproduction of "Wakfu: The Guardians" for free. The characters, universe and logo of "Wakfu: The Guardians" are the property of Ankama and this recreation of the game is not linked to said company. ASHES is an unofficial project led by Krayth, Kyosset and Louky. Despite its status as a private server, Ashes has been authorized by Ankama. We are very grateful to them and all the credit goes to this company and its developers, whom we salute very respectfully.

ARTICLE 1: PRESENTATION OF THE TOS

1.1 The general conditions of use set out the conditions of use of the services provided by ASHES, an undeclared association working on the reopening of the MMO "Wakfu : Les Gardiens", developed by the company Ankama Games.

1.2 These services include access to "Wakfu: Les Gardiens" and the community discord. They will be collectively referred to below as "services".

1.3 The ASHES team, which created the reconstruction of "Wakfu: Les Gardiens", may modify the T&Cs at any time. These modifications will be specifically mentioned on the site and on our communication platforms.

ARTICLE 2: ACCEPTANCE OF THE T&Cs

2.1 You acknowledge that you are a natural person who has reached the age of majority in your country of habitual residence or, if you are a minor over 13 years of age and the law of your country of habitual residence requires it, that you have obtained the authorization of your legal representative to access our services.

2.2 Any use of the services that does not comply with the T&Cs is prohibited and may result in the termination of an account in accordance with the terms set out in Article 4.

2.3 Acceptance of the T&Cs is evidenced by your electronic signature, confirmed by checking the box provided for this purpose to complete the creation of your account. This acceptance is required to create an account and use our services.

ARTICLE 3: USE OF SERVICES

3.1 License Subject to compliance with the T&Cs, the ASHES team grants you a limited, non-exclusive, non-transferable and revocable license. It allows you to access the game "Wakfu: The Guardians" for your personal and non-commercial use.

3.2 License Limitations The license granted to you is subject to certain limitations. Any use that does not comply with the rules of this Article 3 will be considered a violation of the rights granted to you

3.2.1 You acknowledge that reverse engineering, disassembly, decompilation, modification or any alteration of all or part of "Wakfu: The Guardians v.ASHES" is strictly prohibited

3.2.2 You are not authorized to use the client for the development of any computer program

3.2.3 You agree not to create, use or promote any program that may cause damage to the game or alter the gaming experience, such as bots, viruses, hacking tools, cheating methods, automation software and modification software.

3.2.4 You agree not to spy on or intercept communication protocols. Thus, you may not emulate these protocols, retrieve data via packet-sniffing or transport these protocols and their data into another protocol (tunneling).

3.2.5 You may not resell all or part of the client and its accompanying files. In general, you agree not to use or exploit our reproduction of "Wakfu: The Guardians" for commercial purposes.

3.2.6 Selling, buying or exchanging your account is prohibited. A violation of this article will result in the immediate suspension of the account.

3.3 Rules of conduct and prohibited activities

3.3.1 You agree not to insult or threaten other users, to make racist, shocking, offensive, discriminatory remarks or comments contrary to French or international laws (whatever the language used), not to distribute sexually explicit or strongly suggestive content. Incitement to the consumption of drugs and alcohol, to cruelty to animals, or to any illicit activity are also prohibited. The ASHES team cannot be held responsible for any violation of this paragraph.

3.3.2 You agree not to threaten, persecute, embarrass, spam or do anything inappropriate towards another player, such as constantly sending unwanted messages, launching personal attacks or making statements about their ethnic origin, sexual orientation, religion, culture, etc. Hateful remarks are not tolerated and will be immediately punished.

3.3.3 Given the community nature of ASHES, and out of respect for everyone's sensitivities, it is up to the user to maintain a certain level of ethics. As a result, you agree not to communicate on our services your social, religious, political and philosophical opinions or any other idea that could disturb public order.

3.3.4 By providing your content on our services (documents, multimedia content and comments), you are required to comply with the legal and regulatory provisions in force.

3.3.5 The pseudonyms chosen by the user must correspond to the established criteria for communication, set out in these T&Cs.

3.3.6 By using our services, you will incur, personally, the criminal penalties specific to the contentious content, in addition to the possible conviction to pay damages. It is therefore your responsibility to ensure that the dissemination of your comments and content does not constitute a breach of the conditions mentioned above.

3.3.7 You agree not to engage in any form of advertising or commercial promotion in-game via the means of communication made available to you.

3.3.8 In "Wakfu: Guardians v. ASHES", each discussion channel has its function. You agree to use the discussion channels in accordance with their intended purpose. Non-compliant use of the discussion channels may be punished, particularly when it is done in an abusive and deliberate manner.

3.3.9 You acknowledge that the items recovered in the game have no financial value in the real world. It is strictly forbidden to exchange them for real money.

3.3.10 You agree not to trade items and currencies from another game developed by Ankama Games

3.3.11 You agree not to cheat, participate in cheating activity or adopt any other anti-competitive behavior. As such, you agree not to use flaws, bugs or any other form of error to obtain advantages in the game (including, but not limited to, gaining experience, gaining items, saving time, circumventing limitations, duplicating items), nor to promote their use.

3.3.12 You agree to notify our teams when you notice a flaw or error in the game. On the ASHES discord, category "Getting started" => Check the channel "Cmmt_report_un_bug" to get the reporting form, then select the channel corresponding to the appropriate dungeon.

3.3.13 In the game, players are responsible for how they are represented. Any form of cheating will be severely punished. For example, using third-party programs to automate an aspect of the game, exploiting bugs to speed up the progress of a dungeon, or engaging in any activity that gives you an unfair advantage over other players will be considered cheating.

3.3.14 Abusive use of multi-accounting or any other activity likely to harm the gaming experience of other players will be severely punished.

3.3.15 Although the use of multi-accounting is tolerated to do the different dungeons, its use in resource gathering is prohibited; only one character must harvest, the others must be unused and far from any resources to avoid suspicions of cheating.

3.3.16 You must not, under any circumstances, usurp an identity other than your own or falsely indicate that you are a member of the ASHES association, or an employee of Ankama Games.

3.3.17 You agree not to make inappropriate use of the game support service or send false reports to the ASHES team

3.3.18 In general, any behavior that is openly harmful to the Ankama Games company will be severely reprimanded.

ARTICLE 4: MODERATION AND RESPONSIBILITIES

4.1 Actions of our teams

4.1.1 On its services, the ASHES team (acting reasonably and objectively) reserves the right to remove your content if it determines it to be inappropriate, abusive, hateful, profane, defamatory, threatening, obscene, sexually explicit, illicit, invasive of privacy, vulgar, offensive, indecent or illegal.

4.1.2 Depending on the situation, the ASHES team may issue you a warning, temporarily suspend or modify your access to the game for any reason that suggests that your account violates these T&Cs, and at its sole discretion.

4.1.3 Depending on the type of violation or misuse, the ASHES team may terminate your license, thereby preventing access to the game or use of its services, if it determines that you have violated this agreement or that illegal, inappropriate or fraudulent use of the services is detected. You will lose your username and access to our platforms will be prohibited.

4.1.4 If you believe that action has been taken against your account or device in error, please contact our team on our discord server.

4.1.5 The reference language, for the settlement of any disputes, is French. 4.1.6 In the event that a pseudonym does not correspond to the established rules regarding communication, the moderation team reserves the right to rename your accounts on our services, and to apply a sanction accordingly.

4.2 Limitation of liability

4.2.1 Legally, we are not bound by any general obligation to monitor the content transmitted on our communication platforms or on the game. The only obligations inherent to our capacity as host concern the fight against certain content, the conservation of your connection data (processed in compliance with the legal provisions regarding personal data) and the removal of any manifestly illicit content, as soon as we have had actually aware.

4.2.2 You are also informed that, given the intrinsic characteristics of the Internet, the data transmitted, including your content, is not protected against the risks of misappropriation and/or hacking, for which we cannot be held responsible. It is your responsibility, where applicable, to take all appropriate measures to protect this data.

4.2.3 Although our moderation services do everything possible to keep our spaces serene, any content downloaded from our services is done at the user's own risk and under their sole responsibility. Consequently, the ASHES team cannot be held responsible for any damage suffered by the user's computer or any loss of data resulting from the download.

4.2.4 In accordance with French law, the ASHES team may be held responsible in the event of voluntary omission or aggravated negligence, if the actions or measures taken lead to harm to the physical integrity or health of an individual, under any law relating to liability.

4.3 Data processing

4.3.1 Your public written communications may be recorded, analyzed, or deleted by the ASHES team, so that it can check whether your communications comply with the laws and the established CGU.

4.3.2 For inherent security reasons, we collect IP addresses and email addresses associated with users' accounts. No other personal data will be stored in our services.

ARTICLE 5: Updates and termination

5.1 The game "Wakfu: The Guardians v. ASHES" is in principle accessible 24/7, except for interruptions, scheduled or not, for maintenance needs or force majeure.

5.2 The server is backed up as is every 6 hours.

5.3 The team ASHES may at any time cut off access to the game server.

5.4 The ASHES team cannot be held responsible for delays or breakdowns resulting from causes beyond its control. (non-exhaustive list: intrusion into our cyberspaces, fires, floods, accidents, energy shortages.)

ARTICLE 6: ADVERTISING

6.1 Since the ASHES team does not wish to harm Ankama Games, it may promote the other games and services of this company, free of charge, without generating revenue through this implementation.

6.2 On our services, you are not authorized to speak of Ankama Games in unflattering terms. You are free to give your opinions, while respecting the work and personnel of this company.
